Terms
These terms and our privacy policy apply to somnex.io and to kristabourgeois.com, both operated by Somnex.
Who we are
Somnex is a general partnership (vof) registered with the Dutch Chamber of Commerce (KvK) under number 95646205, with VAT number NL867220430B01. Our registered address is De Nieuwe Erven 3, Unit 13885, 5431 NV Cuijk, North Brabant, the Netherlands. You can reach us at +31 6 39226595 or [email protected], and booking enquiries go to [email protected].
What these terms cover
Somnex acts as the Artist's Representative and contracts as principal for live performances by the artists it represents, currently Krista Bourgeois.
Every booking is made under a Live Performance Agreement that the promoter signs. Cancellation, refund, liability and all other terms of a booking are set out in that agreement, and where it differs from these terms the signed agreement and its contract-specific amendments prevail.
Somnex sells no physical goods online, so no shipping or return policy applies.
Fees and payment
Wherever these terms say the fee, they mean the artist fee quoted for the booking, excluding VAT, reimbursable costs and any separately itemised booking fee. The fee is quoted per booking in euros (EUR) excluding VAT, VAT is added where the law requires it, and payment is made by bank transfer against a Somnex invoice or through a Mollie payment link.
Full payment is due no later than 30 days before the performance date, or, where the agreement is signed fewer than 30 days before it, by the earlier of two business days after receiving the invoice and the start of the performance. A deposit applies only where the signed agreement requires one; unless that agreement states another amount it is 50% of the fee, due within seven days after both parties sign.
Governing law
These terms and every booking made under them are governed by Dutch law, and the competent courts of the Netherlands have exclusive jurisdiction, subject to any mandatory rule that cannot lawfully be excluded. Please raise a complaint or dispute with [email protected] first so we can try to resolve it directly.
